GENERAL TERMS AND CONDITIONS
Section 1 Scope
These General Terms and Conditions apply to all contracts between Jamicos - Laura Amico (a health practice for families and therapy center), Bahnhofstraße 20, 6410 Telfs, Austria, and its customers regarding the booking of courses, therapies, and other services, unless expressly agreed otherwise.
Section 2 Conclusion of Contract
A contract is concluded through binding registration (online, in writing, by phone, or verbally) and confirmation by us. The courses and services offered, along with their description, duration, and prices, can be found on the website or in the relevant information sheets.
Section 3 Independence of Therapists / Trainers
The Jamicos community center consists of several therapists and trainers, each of whom acts on her own responsibility, with her own professional liability insurance, and on a self-employed basis. Unless stated otherwise, contracts for individual courses or therapies are concluded directly with the respective course instructor or therapist.
Section 4 Prices and Payment Terms
The prices listed on the website or in the offer at the time of booking apply (including statutory value-added tax, where applicable). Payment is made on-site in cash or by bank transfer.
Section 5 Withdrawal and Cancellation
Cancellation terms are set individually by the respective course instructor and should be requested from her prior to booking. Where a contract is concluded at a distance (e.g. online booking), consumers generally have a statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG), unless an exception applies (e.g. a service to be performed at a specific point in time).
Section 6 Health Data and Duty to Cooperate
The use of services offered by the health practice may require the provision of health-related data. Customers are obliged to provide truthful information to the extent necessary for the proper performance of the service.
Section 7 Liability
The respective therapist / trainer is liable, within the scope of statutory provisions, for damages caused by intent or gross negligence. Any further liability is excluded to the extent permitted by law. Statutory liability for personal injury remains unaffected.
Section 8 Notice on Online Dispute Resolution
Consumers have the right to lodge complaints with the EU Online Dispute Resolution platform: http://ec.europa.eu/odr.
Section 9 Final Provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
